Leasing*a property with a swimming pool, outdoor spa or hot tub
Landlords and real estate agents must ensure that any residential tenancy agreement entered into on or after 29th April 2016:
  • has a Swimming Pool Barrier Compliance Certificate issued within the last three years or a relevant Occupation Certificate; and
  • A copy of that Certificate is provided to the tenant.

Selling* a property with a swimming pool, outdoor spa or hot tub
On and after 29th April 2016 vendors must ensure their Contract of Sale includes:
  • A Swimming Pool Barrier Compliance Certificate or a Swimming Pool Barrier NON–Compliance Certificate (outlining what needs to be fixed); or a relevant Occupation Certificate; all issued within the last three years; and
  • A Certificate of Registration. Failure to attach this certificate may allow the purchaser to rescind the contract within 14 days of exchange, unless settlement has already occurred.

    Fully informed home buyers will be empowered to negotiate a purchase price that takes the cost of compliance into account.
    Those home buyers have 90 days to rectify non–compliant swimming pool, outdoor spa and hot tub barriers.
    Councils can issue fines for non–compliance.

SAFETY
The majority of children under five years of age who drown in swimming pools, do so as a result of fencing that is not compliant with legislation.

The most effective home pool safety measure is proper adult supervision at all times. Portable and inflatable pools capable of being filled to at least a depth of 300mm are required by law to be surrounded by a swimming pool safety barrier.
Ensure the pool gate is always closed and never propped or left open. Learn infant and child resuscitation and display a CPR chart near the pool or spa. Keep pot plants and other furniture away from the swimming pool fence so that they can not be used to climb over to gain access to the pool.
